  • “Services” means our website, Red5 Cloud product, social media accounts, and other marketing campaigns and promotions. 
  • “Program partners” means companies we have carefully selected to provide products or services under.

This Policy has been compiled to better serve those who are concerned with how their Personally Identifiable Information is being used online. 

It describes the types of personal information we obtain when you use the Services; how we may use the information; with whom we may share it; the rights that you have with respect to your information; and the choices available to you regarding our use of your information. This Policy also describes the measures we take to protect the security of the personal information we process, how long we retain it, and how you can exercise your rights and contact us about our privacy practices. Your use of our Services is voluntary. By using, accessing, or downloading the Services, or by voluntarily providing us with any personal information as described in the “What information do we collect” section of this Policy, you accept and consent to the terms set forth in this Policy. If you do not agree to these terms, do not use, access, or download the Services.

What information do we collect?

When you sign up to receive certain types of information (such as email newsletters, product software upgrades, and some license-related documents) or otherwise actively send us data (such as to sign up for the Services, or engage with a website we operate for business partners), we obtain your contact information such as your name, email address, mailing address, telephone number, business details, login credentials, and any other information you provide. This may include personal information to create or modify an account or submitted through our surveys, registrations, reviews, and “Support” and “Contact Us” features.

If you contact us directly by email, mailing us or on our phone lines, or by raising a ticket through our support portal or through our social media channels, we may receive additional information about you that you choose to provide. This information may include feedback on our Services, general questions or questions about technical support and other information that helps us respond to your questions, concerns or requests.

If you subscribe to the Services, we will request that you provide your name and contact information and payment card details (including card number, expiration date and security code). Your payment-related details are collected and stored by our third-party payment processor on our behalf.

In addition, we will also collect the following information: 

  • Transaction information that tells us how you use products or Services, such as your purchase and payment history.
  • Web browser information, such as the type of web browser you use — for example, Microsoft Edge, Chrome, Safari or Firefox
  • Device information, such as device ID, model, operating system, and other device configurations or settings. We may also collect device-related data (such as the IP address of your computer and/or Internet service provider, identifiers associated with your devices). Based on the IP address, we can identify the general location of the device. 
  • Deployment Information, such as dates and times of scheduled deployments, audience sizes by region for each deployment, sources of streams for deployments, authentication endpoints and other infrastructure information required to support deployments.
  • Location information, such as general location information based on your IP address and geolocation information from your browser or mobile device, if you have allowed your devices to share this data
  • If you utilize Red5 Cloud, we process audio and/or video data that you send and receive via the Red5 Cloud platform. Additionally, we process and store audio and/or video recordings from you if you utilize recording or DVR features as part of your use of Red5 Cloud. If you submit content to customer support, we may obtain audio and/or video recordings from you during this process.
  • Other information collected include the date and time you access the Red5 Cloud Management Console or other Infrared5 websites, the Internet address of websites from which you link to our Services, the computer technology you are using, your interactions with and preferences on our Services, usage statistics, and other analytics and technical information. To collect this information, we use technology such as browser cookies, web beacons, device identifiers, server logs, and other similar technologies. For example, we may use these tools to collect information that shows us how you use our products and the Services. This information also shows us how many people click on advertisements on our websites and mobile apps, and on third-party websites. Information about your preferences and interests, such as language and communication preferences, demographics and interests that help us learn more about you, including how you like to do business with us, and what types of products, services or offers you may like or be interested in.

Each time you use our products and Services, you are indicating your acknowledgement and consent to the collection, use and disclosure of information about you collected through the Services as set forth in this Policy. We may revise this Policy periodically at any time. We will let you know of any changes by posting a revised Policy on our website with a new effective date. If you do not accept the terms outlined in this Policy or any revised Policy, please do not use the Services. Any use of the Services constitutes your agreement to any changes to the Policy.

How do we use your information?

We may use the information we collect from you in the following ways:

  • To personalize user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested.
  • To update our products and services
  • To maintain your account and profile
  • To allow us to better service you in responding to your customer service requests.

  • Increase and maintain the safety and security of our Services and prevent misuse;

You are not required to provide to Infrared5 any of the personal information described above but, if you choose not to do so, you may not be able to receive any of the products and services described above, access certain parts of our Services, participate in our promotions, or receive information from us that you have requested. We may combine information we obtain about you (such as through our Services or from third parties) for the purposes described above.

Who do we share information with?

Service Providers

We may share information with service providers that perform services on our behalf. Service providers may assist us with information storage; cloud and web-hosting services; payment processing such as Stripe to support the products that you subscribed to; marketing; advertising; support services; information technology services.

Analytics and Advertising Partners 

In order to provide you with tailored advertising, we may collect information about your online activities. This data collection takes place both on our Services and by certain third parties on the third-party websites and apps that participate in ad networks. The information our ad networks may collect includes data about users’ visits to websites and apps that participate in the relevant ad networks, such as the pages or ads viewed, and the actions taken on the websites or apps. These networks also track users’ online activities across multiple websites and apps over time to build a profile of users’ online browsing and app usage activities. Ad networks collect information through automated means, including through the use of browser cookies, Flash cookies, web beacons, device identifiers, server logs, web beacons and other similar technologies.

We use the following Advertising and Analytic Partners: 

AdRoll: We share information with analytics and advertising partner such as AdRoll to better understand how our users use our products and services and to personalize advertising based on your preferences and interests. These partners may use web technologies, such as cookies, to collect information about your activities on our Website and other third-party sites. 

AdRoll enables us to present you with retargeting advertising on other sites based on your previous interaction with Red5 . The techniques our partners employ do not collect personal information such as your name, email address, postal address, or telephone number.

Google

Google, as a third party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on their visit to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy. We along with third-party vendors, such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions, and other ad service functions as they relate to our website.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information.

Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

Cookies and similar technologies. 

Cookies are the  small files that are placed on your device by a website, containing the details of your browsing history on that website among its many uses. When you use the website or Services, we may send cookies to your computer to uniquely identify your browser session. We may use both session cookies and persistent cookies.  By using the website and/or Services, you are consenting to such use of cookies.

When you use our Services to access or interact with third-party apps and services, we may send certain personal information to these third parties to provide you with the services you request. These third parties also may collect certain personal information directly from your devices. Please see the “Other Online Services and Third-Party Features” section below for additional information on the use of these services. 

If you choose to post a product review on the Services, the content you post along with your first name and last initial will be displayed on the Services and will be viewable by other users. We are not responsible for other users’ use of available information, so you should carefully consider whether and what to post or how you identify yourself on the Services. You may request to delete your product reviews by contacting support@red5.net.

We also may disclose information about you (1) if we are required to do so by law or legal process (such as a court order or subpoena); (2) in response to requests by government agencies, such as law enforcement authorities; (3) in connection with legal proceedings or otherwise to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual fraudulent or illegal activity; or (6) otherwise with your consent.

We reserve the right to transfer any information we have about you in the event of a proposed or completed sale or transfer all or a portion of our business or assets (including in the event of a proposed or completed merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

Data Transfers

We may transfer the personal information we obtain about you to the United States, which may have different data protection laws than the country in which you initially provided the information. To the extent required by applicable law, when we transfer your personal information to recipients in the U.S., we will take measures to protect that information in accordance with applicable law. When we transfer information to data recipients in countries that have not been recognized by the European Commission or U.K.

Information Commissioner’s Office as providing an adequate level of data protection, including the U.S., we implement appropriate safeguards to help ensure that we protect that information as described in this Policy, including by entering into the European Commission’s or Information Commissioner’s Office Standard Contractual Clauses with the data recipient or via other measures in compliance with applicable law.

If you are located outside the U.S., by submitting personal information to us, you understand that this information will be transferred to Infrared5 in the U.S. If you do not want your personal information transferred to the U.S., please do not submit any information to us.

If you are located in the European Economic Area (“EEA”) or Switzerland, we will comply with applicable legal requirements providing adequate protection for the transfer of personal information to recipients in countries outside the EEA or Switzerland.

Where is the information stored and for how long?

We will retain your personal information for the time period reasonably necessary to achieve the purposes described in this Policy, or any other notice provided at the time of collection, taking into account applicable statutes of limitation and records retention requirements under applicable law. After the retention period expires, we will securely delete or anonymize your personal data.

  • We retain backups of your cloud configuration for 90 days, this includes your personal and/or business information, details on the deployments you have configured and the schedules you have created for these deployments. We do not retain backups of your recorded video content; these are uploaded to a cloud storage system that is under your control. This data is stored in multiple locations in both the United States and the European Union in OCI and AWS datacenters.
  • Logs are retained for up to 90 days. Depending on the logging configuration these logs can contain user PII in the form of IP addresses. Data is stored in multiple locations including your default region, the United States and the European Union in OCI and AWS datacenters.

How do we protect visitor information?

We’re serious about protecting your personal information. We do what we can to prevent unauthorized use, sharing, loss and theft of information.

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

We use regular Malware Scanning.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are processed through a gateway provider and are not stored or processed on our servers.

Our efforts to protect your information also include carefully selecting the service providers who handle information on our behalf, and making sure they have privacy and security standards that meet our requirements. We use contracts and other measures with our service providers to keep your information secure and to make sure it is only used for the intended purposes.

We also have policies and practices in place to handle privacy complaints.

We work with Google Advertising to provide interest-based advertisements. To opt out of interest-based Google advertisements, set your preferences using Google Ad Settings. You can also opt out of Google Analytics with Google Analytics Opt-out Browser Add-on

Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt out page or permanently using the Google Analytics Opt Out Browser add on.

If you wish to manage the data you share with us on your device

You can manage access to certain personal information through your device settings. For example, you may allow your device to share your camera, contacts and photos. Some services may not operate effectively without this access. Your device support will have instructions for how to manage these permissions.

If you wish to manage your location information

You can manage access to your location information through your device settings. We collect and use location information from your mobile device only if the location services, such as GPS, geolocation or proximity technologies, are enabled. 

Privacy Information for California Residents. 

If you are a California resident, the California Consumer Privacy Act (“CPRA”) requires us to provide you with the following additional information about: (1) the purpose for which we use each category of “personal information” (as defined in the CPRA) we collect; and (2) the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) “share” personal information for “cross-context behavioral advertising,” and/or (c) “sell” such personal information. Under CPRA, “sharing” is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across websites, and “selling” is defined as the disclosure of personal information to third parties in exchange for monetary or other valuable consideration. We do not sell or share personal information with third parties.

Your Right to Opt Out

You have the right to opt-out of the sale of their personal information by a business. To opt out of having your personal information shared with third parties for their direct marketing purposes, please contact us at support@red5.net.  Once we receive your request, we will process it within 30 days and update our records accordingly.  Please note that your opt-out does not affect the sharing of your personal information when done for purposes other than direct marketing, such as when the information is being shared with a service provider that performs services on our behalf.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do not specifically market to children under 13.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
